The rules, rights, and responsibilities governing participation in the ECO-ONEBRANDHOMES online property bidding platform.
To participate in the ECO-ONEBRANDHOMES bidding platform, you must meet all of the following requirements:
ECO-ONEBRANDHOMES reserves the right to refuse bidder registration or revoke bidder status at its sole discretion, including where required to comply with applicable laws or to protect the integrity of the bidding process.

If you are a licensed real estate professional bidding on behalf of a client, your client must separately register as a bidder and your brokerage must complete our Realtor Registration Form before a bid can be accepted.
The ECO-ONEBRANDHOMES online bidding platform operates as follows:
Each property auction has a clearly stated closing date and time. The bidder with the highest confirmed bid at the exact time of auction close is designated as the winning bidder, subject to seller confirmation where a reserve price applies.
Each bid must exceed the current highest bid by at least the minimum increment specified on each property listing. Bids that do not meet the minimum increment will not be accepted by the platform.
All bids submitted through the platform are binding offers. By clicking "Confirm Bid," you are making a legally binding offer to purchase the property at the stated price, subject to these Bidding Terms. Bids cannot be retracted once submitted except in the limited circumstances described below.
Bid retractions are not generally permitted. ECO-ONEBRANDHOMES may, at its sole discretion, allow a bid retraction only in the event of a documented typographical error resulting in a materially incorrect bid amount. All retraction requests must be submitted in writing to our team within 30 minutes of the erroneous bid and are subject to approval. Approved retractions do not relieve the bidder from the obligation of the previous valid bid amount.
You may submit multiple bids on the same property. Each new bid must meet the minimum increment requirement above the current highest bid at the time of submission. Your most recent confirmed bid represents your current offer on the property.
The opening bid amount displayed on each listing represents the minimum starting price for that property. Some properties may carry a reserve price, which is the minimum amount the seller is willing to accept. Where a reserve price applies, this will be disclosed in the property listing.
If your bid is exceeded by another bidder, you will receive an automatic outbid notification by email and, where applicable, by SMS to the contact information associated with your account. It is your sole responsibility to ensure your contact information is current and accurate.
ECO-ONEBRANDHOMES is not responsible for missed notifications resulting from incorrect contact information, spam filters, technical failures outside our control, or your failure to monitor the platform. We strongly recommend actively monitoring active listings rather than relying solely on notifications.
Upon auction close, the highest confirmed bidder is notified of their winning status by email within one business day. The winning bidder must then:
The winning bid amount constitutes the agreed purchase price. The Purchase and Sale Agreement will include all additional terms, conditions, contingencies, and closing requirements in accordance with Florida real estate law. All transactions are conducted through Ecoways Realty LLC.
Upon execution of the Purchase and Sale Agreement, the winning bidder is required to submit an Earnest Money Deposit (EMD) as specified in each property listing. The EMD is held in escrow by Ecoways Realty LLC or a designated title company in accordance with Florida real estate regulations.
All properties are sold subject to the disclosures provided in each listing. It is the sole responsibility of the buyer to conduct all necessary due diligence prior to bidding, including but not limited to:
By submitting a bid, you represent that you have conducted or have had adequate opportunity to conduct all due diligence you deem necessary and are bidding with full knowledge of the property's condition and characteristics.

All ECO-ONEBRANDHOMES properties are newly constructed using FrameCAD cold-formed steel-frame technology and are built in compliance with the Florida Building Code. Each property is permitted and inspected by the relevant county building authority prior to sale.
Unless otherwise stated in a specific property listing, properties are sold in "new construction" condition. ECO-ONEBRANDHOMES provides a limited structural warranty through its Eco Protection Program for eligible properties. Details of the Eco Protection coverage are available upon request and will be disclosed in the Purchase and Sale Agreement.
ECO-ONEBRANDHOMES reserves the right, at its sole discretion and at any time prior to the official close of an auction, to:
If an auction is cancelled after bids have been received, all bidders will be notified by email and no bids will be binding. ECO-ONEBRANDHOMES shall have no liability to any bidder for losses arising from auction cancellation or modification, except for the return of any Earnest Money Deposits already submitted.

All eligible registered bidders have equal opportunity to participate in our bidding process. If you believe you have been subjected to discriminatory practices, please contact us immediately or file a complaint with the Florida Commission on Human Relations or the U.S. Department of Housing and Urban Development (HUD).
Any dispute arising from or relating to these Bidding Terms, the bidding process, or any property transaction shall first be submitted to ECO-ONEBRANDHOMES in writing for informal resolution. We will make good-faith efforts to resolve the dispute within 30 days.
If informal resolution is unsuccessful, the parties agree that disputes shall be resolved through binding arbitration in Broward County, Florida, in accordance with the rules of the American Arbitration Association, unless both parties mutually agree to an alternative resolution process. The laws of the State of Florida shall govern all disputes.
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
